The Short Version

Welcome to Spark. Here is a plain-language summary of what you are agreeing to.

  • Spark is an AI dog companion. It is not a real pet and not a substitute for professional advice.
  • We collect interaction data (voice, camera, and usage data) to make Spark better.
  • We use interaction data to train and improve AI models.
  • We may share aggregated or de-identified information that does not identify you or your device and is not used for cross-app or cross-site tracking.
  • You own your content, but you grant us a broad license to use it.
  • Subscriptions renew automatically until canceled in Apple Account Settings.
  • Deleting your account does not cancel your Apple subscription.
  • Disputes go to individual arbitration (no class actions).
  • You must be 13+ to use Spark.
  • California residents have additional privacy rights under CCPA/CPRA.

1. Acceptance of Terms

By downloading, installing, or using Spark ("App"), related websites, APIs, or services (collectively, the "Services") provided by Illusion of Life Inc. ("Company," "we," "us," "our"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Services.

2. Who Can Use Spark

You must be at least 13 years old to use Spark. If you are between 13 and 18, a parent or legal guardian must consent to these Terms on your behalf and take responsibility for your use.

3. What Spark Is (and Is not)

Spark is an AI-powered interactive companion featuring a virtual dog. Services may include voice and text interaction, camera and photo features, augmented reality, and in-app purchases.

Important: Spark is an AI simulation. It is not a real animal, sentient being, or a substitute for human or animal companionship, therapy, medical treatment, or professional advice.

5. Data Collection and Use

This is the big one. Please read it carefully.

What We Collect

  • Account and identity data: name, email, username, profile info, date of birth.
  • Voice and audio: voice input processed during use and retained transcripts generated from those interactions.
  • Camera and visual data: camera input processed for live features and retained image descriptions generated from those interactions.
  • Device and technical data: identifiers, hardware, operating system, and related technical information.
  • Interactions and behavior: sessions, feature usage, commands, and preferences.

How We Use Your Data

You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use collected data for lawful purposes, including operating and improving Services, AI model training, analytics, commercialization, advertising, and legal compliance.

How model training works: your interaction data may be used to train AI and machine learning models. Trained models, algorithms, and derivative works are Company intellectual property and may be licensed or sold.

8. Purchases and Subscriptions

Spark may offer paid auto-renewing subscriptions through Apple In-App Purchase. Available plans, billing periods, and prices are shown in the app at checkout and in Apple's purchase sheet in your local currency.

  • Auto-renewal: Your subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period.
  • Billing timing: Apple charges your Apple Account for renewal within 24 hours before the current period ends, at the price and plan you selected.
  • Manage or cancel: You can manage and cancel subscriptions in Apple Account Settings on your device after purchase.
  • Price changes: We may change subscription prices from time to time. Apple will notify you and request consent when required by applicable law and App Store rules.
  • Trials and promos: Any unused portion of a free trial or promotional period is forfeited when you purchase a subscription, where applicable.
  • Refunds: Payments are handled by Apple. Refund requests must be made through Apple and are subject to Apple's refund policies and applicable law.

9. Account Deletion

You can request account deletion from authenticated settings surfaces, including the web dashboard and the in-app embedded settings flow.

  • When requested, your account is disabled immediately and signed out.
  • Your account and associated profile data are scheduled for permanent deletion within 7 days.
  • Deletion requests cannot be undone or restored once submitted.
  • Deleting your account does not automatically cancel your Apple subscription.

To avoid future subscription charges, cancel in Apple Account Settings before your next renewal date.

13. Disclaimers

Services are provided "as is" and "as available" without warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, consequential, punitive, or special damages. Total liability is limited to the greater of amounts paid in the previous 12 months or USD 100.

16. Dispute Resolution

This section affects your legal rights, including waiver of jury trial and class action rights.

Disputes are resolved by binding individual arbitration in San Francisco, CA under AAA Consumer Arbitration Rules, except either party may seek injunctive relief in court when appropriate.

17. California Privacy Rights (CCPA/CPRA)

California residents may have rights to know, delete, correct, opt out of sale/sharing, limit use of sensitive personal information, and non-discrimination under applicable law.
